ACT rental reforms set out minimum energy efficiency standard for ceiling insulation

The ACT Government has published further detail on how the ACT tenancy reforms due to commence on 1 April 2023 will provide greater comfort to tenants, literally. A media release published earlier today states that “rental homes across the ACT will now have to meet a minimum energy efficiency standard for ceiling insulation which will help keep Canberra homes comfortable, safe and energy efficient”.

ACT tenancy reforms to commence on 1 April 2023

In late 2022, the ACT Government announced plans to make changes to the current Residential Tenancies Act 1997 (the Act). In a media release this week, it has been confirmed that changes to tenancy legislation for the Territory will include:

  • The removal of ‘no cause’ evictions,

  • Prohibiting landlords and agents from asking for or encouraging rent bids,

  • Allowing tenants greater freedom to grow their own food and to compost, and

  • Creating a framework to support the future introduction of minimum housing standards for rental properties.

The changes are due to commence on 1 April 2023.

Are you an agent in the ACT who deals with property developers? As key property industry stakeholders, real estate agents bring valuable community insight and perspective when it comes to new property developments.

The ACT Government has announced in a recent media release that they have opened consultation with the community to ask for its views on a discussion paper that considers a range of issues and proposes different options for developer regulation.

The discussion paper looks at a range of approaches to improving the accountability of developers and providing consumers with greater information about developments and the developers behind them.

ACT residential tenancy law reform: Ending no-cause evictions and rent bidding

Changes are coming to the current ACT residential tenancy legislation, the Residential Tenancies Act 1997 (the Act).

The Residential Tenancies Legislation Amendment Bill 2022 (the Bill) was introduced to the ACT Legislative Assembly on 30 November 2022.

The Bill proposed to:

  • End no-cause evictions and introduce new ‘with cause’ termination provisions to support landlords to manage their properties

  • Restrict solicited rent bidding

  • Allow tenants greater freedom to grow their own food and compost

  • Create a framework to support the introduction of minimum housing standards for rental properties.

Trust account audit procedures differ depending on the state or territory in which you operate. These requirements are set out in property legislation, with each regulatory body often outlining and summarising trust account obligations online via their websites.

Trust account audit guidelines exist to ensure that trust money held by agents is properly managed and can be accurately accounted for at all times. Serious penalties may be incurred by agents for the misuse of a client’s money, including heavy fines and imprisonment.

New laws: Property industry reforms in the ACT

From 1 July 2022, the ACT government will be introducing changes to the regulation of the real estate industry.

The reforms will include changes to:

  • licence and registration categories

  • qualification and experience requirements for licences and registrations, and

  • restrictions on the activities each licence and registration group can undertake.

Come 1 July 2022, the College will be releasing ACT legislation-based courses in line with the new training requirements, to help students ease into the reforms and ensure they are compliant with their educational requirements as outlined by Access Canberra.
