This guide addresses the requirements for gaining an entry-level registration within each state and territory of Australia. In Australia, each state and territory has different eligibility requirements that must be met before an individual can start work in the real estate industry (including specialty areas such as business broking, stock and station, and acting on behalf of buyers).

The basics

Before we get into the particulars for each state and territory, let’s look at the basic entry-level standards required by licensing bodies across Australia.

What is a ‘fit and proper’ person?

One aspect of eligibility that is common across all states and territories is the requirement that you be a “fit and proper person”. This often means that you must not have any disqualifications against your name from previous participation in the property industry, and that you have not been convicted of a serious offence that the licensing body may consider detrimental to your ability to act honestly and with integrity. Your relevant licensing body will consider these matters on a case-by-case basis when processing applications.

Age requirements

To apply for an entry-level registration, most state and territory licensing bodies require applicants to be at least 18 years of age. The one exception here is NSW, whose licensing body (NSW Fair Trading) allows registration applicants to be of 16 years of age.

Requirements by state/territory

  • Education requirements: NSW Assistant Agent (Certificate of Registration) course
    Regulatory body
    : NSW Fair Trading

    All applicants for a certificate of registration must prove to NSW Fair Trading that they:

    • are at least 16 years of age

    • are a fit and proper person to hold a certificate of registration

    • have the qualifications required for the type of certificate of registration for which they are applying

    • have not been disqualified.

    Once you have been granted a Certificate of Registration, you must work towards completing the full CPP41419 Certificate IV in Real Estate Practice (Class 2 licence) within four years of your registration date.

  • Education requirements: QLD Real Estate Salesperson (Salesperson Registration Certificate) course
    Regulatory body: Queensland Fair Trading

    All applicants for a salesperson registration certificate must prove to Queensland Fair Trading that they:

    • are at least 18 years of age

    • pass the required training course

    • are not currently disqualified from holding a licence or registration certificate

    • have not been convicted of a serious offence within the past 5 years.

  • Education requirements: There are three enrolment options for registration in WA. See below.
    Regulatory body: WA Department of Mines, Industry Regulation and Safety (DMIRS)

    In WA, property management and sales functions are completed under separate registrations. You also have the option to gain an “unrestricted” registration, which would allow you to work in both property management and sales roles.

    1. Education requirements to work in property management role only: WA Sales Representative Registration (property management) course.

    2. Education requirements to work in sales role only: WA Sales Representative Registration (sales) course.

    3. Education requirements to work in both property management and sales roles: WA Sales Representative Registration (unrestricted) course - CPP41419 Certificate IV in Real Estate Practice.

    All applicants for a certificate of registration must prove to WA DMIRS that they:

    • are at least 18 years old;

    • are a person of good character and repute and a fit and proper person to hold a certificate of registration;

    • understand fully the duties and obligations imposed by the Act on persons involved in negotiating real estate transactions and business transactions.

  • Education requirements: ACT Assistant Agent Salesperson Registration (core units)
    Regulatory body: Access Canberra

    All applicants for a salesperson registration must prove to Access Canberra that they:

    • are an adult (an individual who is at least 18 years old)

    • have the required qualifications

    • are not disqualified.

    Once you have been granted a Salesperson Registration, you must work towards completing a further five units of competency from the CPP Property Services Training Package within 12 months. You may choose to complete units relevant to residential property sales or residential property management.

  • Education requirements: There are three enrolment options for registration in SA. See below.
    Regulatory body: Consumer and Business Services (CBS)

    In SA, property management and sales functions are completed under separate registrations. You also have the option to gain an “unrestricted” registration, which would allow you to work in both property management and sales roles.

    1. Education requirements to work in property management role only: SA Property Management Registration course.

    2. Education requirements to work in sales role only: SA Sales Representative Registration course.

    3. Education requirements to work in both property management and sales roles: SA Unrestricted Registration course.

    All applicants for a property management and/or sales representative registration must:

    • provide CBS with proof they have completed the relevant qualifications or that they are enrolled and working towards a relevant qualification (this enables trainee registration)

    • have a police clearance no more than 12 months old

    • be at least 18 years of age

  • Education requirements: VIC Agents’ Representative Registration course - CPP41419 Certificate IV in Real Estate Practice
    Regulatory body: Consumer Affairs Victoria (CAV)

    You do not need to apply to a licensing authority to work as an agent's representative. Instead, your employer is required to verify that you are eligible to be an agent's representative, and notify the Business Licensing Authority (BLA) via myCAV when you start work.

    To be eligible to be an agent's representative you must:

    • be at least 18 years old

    • have completed a course prescribed under the Estate Agents (Education) Regulations 2020

    • not have been found guilty of any offence involving fraud, dishonesty, drug trafficking or violence punishable by three months or more imprisonment (whether or not a jail term was imposed), within the last 10 years

    • not be insolvent under administration

    • not be the cause of a successful claim against the Victorian Property Fund or a corresponding fund

    • not be a represented person under the Guardianship and Administration Act 1986

    • not be subject to a Victorian Civil and Administrative Tribunal declaration making you ineligible to act as an agent’s representative

    • not be subject to an order by any regulatory body in or outside Victoria, disqualifying you from acting as an agent’s representative.

    The BLA may grant you permission to be employed as an agent’s representative if you are subject to some of the restrictions listed above (if you are insolvent, are the cause of a claim against the Victorian Property Fund, or have a disqualifying criminal record).

  • We do not currently offer courses for Tasmania property licensing and registration. Courses will be available in late-2022.

    Education requirements: TAS Property Representative Licence course - CPP41419 Certificate IV in Real Estate Practice (coming soon)
    Regulatory body: Property Agents Board of Tasmania

    The CPP41419 Certificate IV in Real Estate Practice compulsory qualification requirement only applies to property representatives who have not been previously licensed before 1 August 2021 or have been unlicensed for a period of over two years.

  • Education requirements: There are three enrolment options for registration in the NT. See below.
    Regulatory body: Northern Territory Agents Licensing Board.

    In the NT, property management and sales functions are completed under separate registrations. You also have the option to gain an “unrestricted” registration, which would allow you to work in both property management and sales roles.

    1. Education requirements to work in property management role only: NT Agent’s Representative Registration (property management) course.

    2. Education requirements to work in sales role only: NT Agent’s Representative Registration (sales) course.

    3. Education requirements to work in both property management and sales roles: NT Agent’s Representative Registration (unrestricted) course (CPP41419 Certificate IV in Real Estate Practice).

    To be eligible to apply for an agent’s representative registration with the NT government, you must:

    • be 18 years or over

    • be a fit and proper person

    • hold the prescribed educational qualifications

    • be employed by, or in the service of, a licensed agent within the Territory

    • obtain a criminal history check

    • advertise your application.

    If you are offered work before you have finished your training, you can apply for a one-year interim registration as an agent’s representative (training). Read about the ‘Short term registration’ on NT.GOV.AU.
